I recently purchased a home in rural New Jersey. The home was built over 30 years ago, and a detached garage was included. Although the garage was built by the previous owners of my house, and my property has always used the garage exclusively and pays taxes on the structure, a survey showed that the boundary with the neighbor runs through the garage. Now the neighbor is claiming the garage is his, although when he bought his house four years ago he made no such claim. The town has no record of when the garage was built, but it does have the permits filed for a garage renovation ten years ago by the previous owners of my house. Although we agreed to not use the garage until the dispute was resolved, the neighbor has moved equipment into the garage for the first time. I cannot afford to hire an attorney to take him to court or to prove adverse possession. My questions:
1) The only options I can think of are that one of us needs to grant the other an easement, or we need to tear the garage down. I am not willing to grant the neighbor an easement, nor is he willing to grant me one. Are there any other options?
2) If I tear down the garage without his consent, am I liable for vandalism or destruction of his property?
