Question Who's My "Baby's Daddy?"
I have a complicated situation at hand....

I have been a FL resident since '94, originally born in GA. I was married in '04, and my husband is also a FL resident but not a native. We have one 2-year-old son together, who was born here in FL in '05. Here's where the situation gets sticky...

I haven't seen or heard from him since 15 months ago. We are separated, abandoned, or whatever the terminology is, but it has not gone through the court system or anything. I have no idea where he is currently located, although I believe him to still be living in FL. However, we are still legally married and I am currently pregnant with another man's child.

I guess I have several questions:
1. Am I able to put the biological father's name on the birth certificate, or give my child another last name if the first is not possible?
2. If I have to put my husband's last name or my maiden name on the birth certificate, will I later be able to place the biological father on the certificate?
3. My friend says that under FL law, my husband will be responsible for child support because we're still legally married. Is this true?
4. What if paternity is established for the other man? What are his rights?
5. Does my husband have any rights to the baby, even though there's no possibility of him being the biological father?
6. If I receive gov't benefits for the baby, who is responsible for the mandatory child support that the state requires you to sign up for? The biological father or the soon to be ex-husband?

Any info back would be great...this is a very confusing situation for me, and I just want to have all of my ducks in order before I have the baby and know what's lying ahead for me.

Your legal husband is considered the father. The good news is, he probably will not have any problem agreeing to a quick divorce as he will be looked on as the father....child support the whole nine yards, so your friend was right.
Estabilsh paternity after the baby is born, the bf will get the bill for child support and also will be allowed visitation.
Your husband will be the one getting billed for the states services. They will find him and then he will come after you. This can and will come back to bite you in the behind along with your boyfriend. Not a wise move at all.
