    Post Have You Ever Been Convicted?

    Our Executive committee wants to change our employment application to reflect the following:

    "Have you ever been convicted or plead guilty to a crime other than a traffic violation within the last ten years?"

    and

    "Do you have any criminal charges pending?"

    I know that we can ask if one's ever benn convicted but can we ask if they've plead guilty and whether or not they have any charges pending?

    Laws are different in each state.

    It seems you can in La. per my reference but you might want to run it by your legal dept. first.

    They must comply with the FCRA (Fair Credit reporting Act)
    Not just the State....

    The FCRA does not prohibit such a question.

    Agree - "asking the question" does not matter to the FCRA.
