Husband's Immigration Status After Divorce

I brought my son's father with the K3 visa. . We had an appointment for permenat residence in Dec 2003. Since at the time we were in a very heated breakup, I decided not to go to the interview. . .

Well, I want out. I want to get divorce, I don't love him anymore. . .And since we have a 4 year old son, I don't want him to get deported. I want him to get his residence. . .His visa expired on Jan 2004.

Is there a way that he can go and get a new intreview without my help?

I am not willing to do an affadivit of support since I don't trust him, I want to get divorce within the next 6 months, but I am willing to go to the appointment and tell them the truth.
