    Default What Is A Proposed Judgement?

    What is a proposed judgement? Is there a form? If so which number? Does it has to be filed with court or send to the other party? Or just taken to the court date? This is in a bifurcation trial that takes place next week and other party requests a proposed judgement. Thanks for your help. In California

    A proposed judgment is exactly that - something you propose as a judgment. Why wouldn't you submit the judgment to the other party in advance of the hearing? If you don't and they argue that it is not appropriate, your chances of getting it entered plummet.

    If you are unable to figure out how to prepare a judgment, how about suggesting that the other party prepare the judgment for your approval?

    Yes that makes sense - but what is it in a bifurcation trial? How can you submit a proposed judgment if it is a bifurcation trial that has nothing to do with financial settlement (that is why you do bifurcation or what is bifurcation - a divorce status only). So you wouldn't sign/approve something already in the bifurcation trial that has to do with financial stuff. So I wonder what is in the proposed judgment in this case?

    If you submit a proposed judgment after bifurcation, it would presumably be a final order in relation to one or the other aspects of the bifurcated proceeding. Talk to your lawyer.

    No the bifurcation trial is still going on - it is not over yet!
