US Citizen Wants To Marry Girlfriend Who Is An Illegal Alien

I am a US born citizen, and I'm a sophomore in college, turning 21 in a couple of days. My girlfriend came on a tourist visa and overstayed. She's a freshman and 19 right now. Her family has been denied a green card twice (Once while their visa was valid, and once three years ago because they didn't fit one of the standards to get a green card under some new law. She was able to get a social security number and temporary working permit that expired within a year.)

My question is, are there any troubles for proving that the marriage will be legitimate based on our age? I feel like we would get married anyway, it's just that I want to help her a little sooner, as soon as possible. As to the affidavit problem, I have an uncle who is a US citizen who agreed to be our sponsor. Do you think I can help her out?

Do you want to be married to her, or do you want to "help her"?

The USCIS will take a pretty intense look at your life to try to determine if your marriage is bona fide.

In the current climate? Not so much, unfortunately.

I don't want to sound mean or dismissive, but this is not the sort of thing you would enter into lightly. Don't even consider getting hitched unless you are doing it because you're mad about each other and cannot imagine life apart.

Unlike every other couple who gets married, you two will be examined under a very harsh microscope. If Immigration thinks this is a "marriage for a green card", she'll be deported and you'll be in serious trouble.

On the other hand, if the two of you are talking about what your life will be like 50 years from now and you're daydreaming about what your kids are going to call your grandkids, get an attorney and good luck!
