    The constitutional prohibition against excessive bail is one of the few provisions of the Bill of Rights that has never been "incorporated to the states", meaning that unless the state constitution includes a similar provision, or the state legislature has passed a law restricting bail amounts, state judges are at significant liberty to post a bond the defendant cannot reasonably afford.
