Default Workers Comp Problems In Indiana
My husband hurt his knee on the job. He is a commercial carpenter. He immediately informed his supervisor on the job. He didn't think that it was a serious injury at the time, maybe just a sprain, but after he go home it got worse. He was unable to walk the next morning, called his employer and the told him to go to the local ER. The ER Dr. referred him to an orthopedic surgeon. He went and that Dr. ordered an MRI. In the mean time, his employer finally filed the WC claim with their insurance co. This was three weeks ago and we still have not had his claim approved or denied. The WC has stated that they will probably deny his claim because two of the people he was working with wrote in their statement that they thought that it was his ankle that was injured. If his claim is denied because of this, what can we do? He is still in his immobilizer and is unable to work. Thanks for any info you can pass along!

I don't get it. What should it matter what these co-workers are alleging is the injured part??? That is a decsion to be made by a Doctor and check you state rules cause after 3 weeks here in Mi. you can go to your own Dr. for treatment which is much better than having to deal with some crappy 'urgent care clinic' that wouldn't know a body if it was brought in on a guerny(sp?) and is supossed to deny your claims and send you back to work quickly thats why the big companys send their employees to places with names like Concentra Care Clinics, etc. you may need to get an attorney since they sound like they are not real convinced that your husbands injury is real(also get used to that mindset, when an injury is ongoing employers, co-workers, HR depts. supervisors, start to get weird and hostile towards the injured person... And will play the proper 'mindgames' with you so, you will know they are not happy with you being off of work. It does sound like this injury is documented. The worker comp person who told you that it would probably be denied because of the 2 co-workers giving a conflicting injury site should not be the legal grounds to deny a claim. The Dr. would be the person to make that determination. Go to your own Dr. and get out of 'their' evil clutches. Did a Dr. write you a 'unable to return to work' excuse due to this injury? Then the companys workers comp people are blowing smoke at you. Which shouldn't suprise you? If the injury continues then you may see things get real stupid.
