    Default Custody Case, USA and France

    Hello,

    I am a French citizen and have a child with an american citizen. I have tried to bring the child to France but its other parent refuses to let me do so. Moreover, s/he would only allow me to visit the child when it was convenient or him/her (the parent, not the child ). Being fed up with this unfair control, I decided to go to court.

    I asked the court to let me take my child to the emabassy so s/he could be registered as a French citizen, and to allow me to take her/him to visit her/his French family.

    The court ruled in favor of the defendant, saying that I can not take the child out of the country, etc,etc, going to the point to make me pay for the defendant's lawyer fees etc.

    Feeling like I have been cheated somewhere and like the situation is totally unfair (who denies a child its natural right to know his family?) I am asking what can be done from there?

    Am I gonna be only allowed to see my child if I come to visit to the usa? I am back in France now and live there and work there...

    Welcome to the American court system! I would contact the French embassy myself that is the only starting point I can think of for you. They may be able to help you get started.

    What state is this in? Did the court feel you were capable of not returning the child? It is unusual for a court to deny visitation in a NCPs home country unless they are concerned that the child will not be returned.

    it is in missouri. I have no idea why the judge decided that. I can take care of the child perfectly well, i have been doing so everytime s/he was around me...

    as if not being able to bring my child to meet his/her other half of the family was not enough, i have to pay all of the defendant's expenses. What can be done form there? Is an appeal a good solution or am i gonna end up having to pay more and get even lesser rights than now?

    What do you mean "pay defendants expenses"? Attorneys fees? Child support? Alimony? Please clarify.

    And what was the ruling regarding foreign travel...did the Judge just say no without giving a reason for the denial?? Are you living in the US or in France? How old is the child? Did you offer to pay a bond in order to be allowed to take the child out of the country? When was the order issued and have you filed a appeal?
