I am writing from Illinois. I have lived with, cared for, etc my nephew since my developmentally disabled sister brought him home from the hospital. Long story short, she also has behavioral issues, a history of voluntary homelessness, dating a pedophile, list goes on. Initially, she and her then husband gave guardianship to my mother, then I was given successor guardianship. Since both were signed of on by a judge, does this make it a court ordered guardianship?
With each new boyfriend comes the momentary decision that she wants her now 5 year old son back. He has mild cerebral palsy which requires therapy, is soon to be starting kindergarten, and a calm home routine. I am mommy to him. My sister operates mentally at a child's level, her involvement with "her" child has always been urged by me for his sake, but she only wants him when there's a fun activity for her involved. She lives on disability due to her mental status, is supporting a man who doesnt want to work and they both smoke pot, an activity she didnt bother quitting when she was pregnant. Can she really walk in at any time and just take him back?
