    Default Change To An Earlier Court Date

    Chicago, IL -> First District of Cook County Court

    Hi all,

    I'm the plantiff (going Pro Se) in a forcible entry and detainer against my roommate who has not paid his rent. Today was the first return date and I was informed that he was not served the summons. He has not been in the apartment since I gave him the 5-day notice in December.

    Today, I filed for constructive service by posting (with the affidavit and notice of pending action). However, I filed the wrong court date: choosing one that was over a month away instead of 2 weeks. The clerk I was filing with noticed this as he was entering in the paperwork but did not let me change the date.

    How do I go about changing the court date to an earlier one so I am not waiting over a month for my next court date?

    Unless you think the roommate is going to move back in, I wouldn't worry about it. Getting an earlier court date will likely be more bother than it's worth, likely at least requiring new notices and service and possibly even requiring you to dismiss and refile.
