    Default Army National Guard Deployment

    Hi

    I have a question. My husband recently joined a Blackhawk unit in the Army National Guard. He does not have a MOS yet but he was active duty before and has the MOS as a Chinook mechanic so he will have to retrain first to get the MOS as a Blackhawk mechanic.

    3 days ago he was told that he would have to deploy with a Infantry Brigade Combat Team even though he was never infantry in his whole life. Is is legal, that the National Guard activates individual soldiers to attach them to a different unit? I thought the National Guard only deploys as a whole unit? Do they have the legal right to pull only individual soldiers out of their unit? It would be for 10 months so would that still be considered a TDY?

    Second is is ok to deploy someone in a combat unit that does not have a combat MOS and will now not even have the time for any training because this unit will deploy in about 4 weeks but already started full time training last year in October? Plus can a unit attach someone to another unit if this soldier does not even have a current MOS with the losing unit?

    I'm answering your questions in reverse order in an attempt to help you understand a little better.

    He has a combat MOS, his prior sevice training and bootcamp qualify him for this. Also the training since October. Being combat ready is something everyone has coming out of bootcamp. He has prior service, so this counts. They can put anyone anywhere.

    Yes, they own him. They can do whatever they want. Sorry this sounds cold, but its the truth.

    It would be for 10 months so would that still be considered a TDY?
    This is something that your husband will have to find out thru his unit. What is his obligation to the Guard? I'm refering to the # of yrs he signed up for.

    He has a 6 year contract but only needs 2 years until he can retire

    Can I assume that you were not married to him during his years of active duty?

    Not having his MOS yet probably hurt him a little. His area is very specialized and the MOS's come by less frequent. Let me clairfy on the TDY..TDY is temporary duty. Were you asking if this counts towards active duty? Answer is yes. If your asking the question if its considered a deployment and count towards deployment obigation? This is what he is going to have to ask his unit. Is this new unit going overseas?
    The good news is, it will count towards active duty days when caculating his retirement pay.

    We are misunderstanding each other. I only want to know whether the National Guard has the LEGAL right to mobilize an individual soldier to attach him to another unit. I know the Reserves work that way but the NG is supposed to only deploy as one whole unit

    Yes they do. He also had the right to volunteer to go to another unit as opposed to being sent. You can contact his company commander of the unit he is supposed to be in, they might be able to explain things better.

    Yes, they do have the right. It sucks and that's why people are telling their congresspersons what is happening to their family members and the jobs of their familymembers. What is happening is BS and our Congressional officials need to know what is happening because the Army is understaffed.

    By activating them they are calling them IA's, or Individual Augmentees. Be glad that he is going for 10 months and not 15 months.

    Regarding the BCT, everyone is a soldier, everyone is a rifleman even if they are not an 11B (Infantry) as their Primary MOS.

    They need Chinook mechanics and I am surprised that they are not trying to find him a home.

    ...I know of many people operating outside their MOS in the states; that will be exacerbated overseas. If he can type and type well he may be able to stay in an office.

    The other good news...that 10 months will count as 20 months towards retirement for Guard and Reservists, if I am not mistaken.

    I am from a military family (National Guard to be exact). When the National Guard deploys they then fall under the regular Army laws and regulations. It is what is called Title 10. When they are under these order they are under Federal not state anymore. Are you out of Indiana?
