Unhappy Offered Settlement In Michigan
Yesterday we received a letter stating the Insurance company wanted to settle. Basically they are offer $50,000 cash up front and then $442.00 monthly for 12 years.
Here is background info. Husband (he is 57 now) was hurt at work 10/2005. After being sent to to many different doctors to remember and have to many tests and different treatments, none of which worked, he had surgery on his neck 08/06. They did Anterior Cervical Discetomy, fusion c4-5,c5-6, C6-7.

He went back to work light duty 10/06, which now we know was to soon. Anyway company closed their Michigan plant and he was laid-off 09/07.

His permanent restrictions are No lift over 15lbs, no repetitive over-the-shoulder, no repetitive twisting at the torso or at the shoulder or the neck. No hyper extension or hyper flextion of the neck. Also five minute interval breaks when neck pain does flare-up and no repetitive pushing or pulling.

He has been in Industrial Maintenance for over 25 years. His surgeon told him you will no long be able to do that kind of work. He also can now long ride the jet ski's or go snowboarding. We had to sell jet ski's and snowboard. Husband ask what can he do now and doctor told him take up fishing.

He is still in pain to some degree 24/7 and will be for the rest of his life. He will also have to take sleeping pills for the rest of his life to able to sleep more than 3 or 4 hours without waking up in pain, which he hates and will not take them nightly. His left hand still does numb and he drops things he thinks he had a hold of. Our physical relationship is zip because I am afraid I might hurt his neck and of course he is afraid of hurting worse.

The insurance companies offer of about $117,000 really upset me since he will suffer daily for the rest of his life and can not longer work. He would gladly work rather then sit home day in and day out. This is or was a very active man.

We are not looking for a settlement in the millions but would like to know his future medical will be covered and I don't have to work 2 jobs 7 days a week for the next 20 years just to make ends met.

Yes, we have been in contact with a lawyer but have not hired him, he has just been giving advise at this point.

Any thoughts or information on what to do now?

You are in a good position to negotiate with an attorney to take your case based on his fee coming out of anything additonal he can get for you.
