Default Getting Garnished
Please help if you can. I work and live in Ohio. As you read from my title I am being garnished. I am separated from my husband and been for almost 4 years. He has another family with someone else so I live alone. I want nothing from my estranged husband as he pays a bill or two once in a while for me. Anyway last year I only made $8847.40 and I doubt that I will make much more this year. I get paid bi-weekly and on my last paycheck they took out $123.59 leaving me to live on $115.41 to live on for 2 weeks. I can't pay my house payment or for my medication on that. I went to Job and Family services and they gave me food stamps. They also offered me a chance to use the WIA program.

They couldn't help me with the garnishment and when I call Lawyers and explain my situation and ask about a payment plan most say they can't help me. I am afraid I'll lose my home. I was just barely making it before the garnishment. Can someone please direct me into what I should do? I plan to use the WIA program and go back to school and get a better job but I need immediate help with putting a stay on the garnishment as I am hoping to someday pay the bill. It was for a credit card by the way.

Thanks Happy Trails but I want to pay this money. I honest to God owe it. I believe that after going back to school and getting a good job through the WIA program I will be able to pay. Also though the cards are solely in my name I worry that Bankrupting would adversely affect my estranged husband's credit. He is currently trying to buy a home for his lady friend and their child. I don't want to cause his current family problems since he and I didn't work out. Plus the mortgage is in my name solely but the deed to the house is in both our names so I don't want him to force me to sell the house should I upset him.

Ok Happy Trails you win if bankrupting is my only choice I guess I have to do it. Now the problem is how to get a Lawyer to help me on a payment plan. Job and Family Services here in Ohio can't help me as their legal aid department doesn't deal with those type of issues.

Do you have a local legal aid society or a local university that has a law school? Also, you might contact your local United Way & see if they have any suggestions.
