Default Fired While On Workman's Comp
I was a loan officer and sent out to collect a loan payment for a delinquent customer (not my job, we have a collection department, nor was I trained in that field) I was robbed and threatened, fearful of my life. The attackers got away with all personal info and objects. I am a rape survivor in which the attackers showed up at my home after the rape, they still never caught them. After the loan collecting attack, I was unable to return to my own home for two months fear of the attackers returning and diagnosed with post traumatic stress disorder. I am on meds now for anxiety and depression. I have barely left my home all this time and feel very unsafe outside my home. HR kept calling my doctor about when I was returning full time and I had repeatedly asked the company to put it in writing that policy be changed and I would no longer have to ever do that again, as well as wanting to save others of this type of experience. They refused.

I was off for 3 months and returned to work for two hours a day. I was then terminated 3 days later for "just cause" on sometging that was investigated 8 months ago. I thought it was all handled back then since I had permission to do the loan. However, they reopened the case and I was fired. What are my rights? Can I report them for endangering employees? Do my workmans comp benefits end since I was only released for two hours? I know they fired me for my persistence to change policy but I felt it was my duty to press the issue. I am at this point suicidal and feel so helpless. Anyone have any advice?

Please immediately call your doctor or go to the emergency room and tell them of your suicidal thoughts. You need to do this RIGHT NOW. All the rest can wait, you have a lot of time to exercise your rights in this matter. You ARE going to get through this. I've been injured and in and out of worker's comp for five years now. Yes, it seems overwhelming at times, and it's easy to get depressed and start going downhill quickly - but there are people who will help you get through this.

Your entitlement to worker's comp benefits do not end because you had a two hour a day work release or because you were fired. You do need to see a lawyer at this point though to protect and take full advantage of your rights.

But first, go get some medical help with your depression or at least post back here. I'll be back on here later this evening after a doctors appointment if you need someone to talk to - now go call your doctor
