    Default Texas Private Repo

    I have a written and signed contract with a (ex)friend to purchase my truck. he gave me 1k down and paid on it for exactly one year at $300 a month. he has not made a payment for the last 4 months and still owes over 3 grand. I have made every attempt to locate him without using a PI. I have gone to the civil court to file a smail claims lawsuit and they told me they will not locate him for me. I have his last known address which is his mothers house, and she has basically told me to get bent. I am wondering if there is a law in texas that he can be held criminaly liable for not turning over a "reposessed" vehicle, and do I also need to give him some sort of written notice that I have every intention of repossessing my truck.

    btw, the title is still in my name, and I do have a spare key to the truck. I just cannot find him or the truck. thank yo very much.

    To do anything civilly, you need to find him or the truck.

    You can try to file a police report. My guess is that the police will tell you that it's a civil matter.
