Default Affidavit of Paternity Statute Of Limitations
This is in New York state. I had a son with my ex-girlfriend (we were never married) and I signed the Acknowledgement at the hospital, I am listed as his father there and on the birth certificate, and he has my last name. He will be 2 yrs soon.
We split up and she told me another man was the father and he did take a DNA test, not court admissable that says he is the bio father.
We are in a dispute over custody and have learned that my signing the AOP has given me the legal rights as the father but now the mother says she is going to petition the court to have me removed. I do not want to be removed, he is my son regardless of DNA and I am willing and fighting to keep him in my life always.
Can she have the AOP changed/dismissed and can she change his last name legally without my consent?
