Question Workman's Comp Case In New York
Can someone please help me.

I was injured in March of 2007. Initially my employer didn't turn over the case to the insurance carrier until June of 2007. From March 07 through June 07 I was seeing my primary Doctor regarding the injury I sustained from the fall I had taken in the parking lot of my job. Due to that fall I now suffer from Neck, Back (upper and lower), Shoulders, Hands and knee pain. I was diagnosed with (4) C3-C4-C5-C6 herniations in my neck, Moderate arthrosis in my L5-S1. Moderate tendonitis in both my Right and Left Shoulders. Carpal Tunnel in both Right and Left Hands due to the falling on my hands and wrists. I have had 5 doctors including 2 of the 3 IME doctors I have seen agreeing to my degree of disability and relating the injuries due to my fall in March 07.

1 of the IME doctors claimed there was absolutely nothing wrong with me, although he had all the MRI/XRAY @ Doctor reports. When the insurance carrier recieved that. They had terminated my workmans compensation medical insurance. Now I cant be seen by anyone because of no insurance. I had just went to court for the first time in 7 months. They granted me money retro to me during the course I was collecting money. Which only was for 7 weeks before they terminated that. But no judgement on the medical coverage I need for my injury. In the process of all this. I still had my own personal medical insurance through the company. Until January, They cancelled that without notifying me of an insurance change. Can they just cancel my personal medical insurance? I have so many questions and no answers. I dont seem to have any luck getting answers through my own attorney. I don't know what happens now. I assume I have to wait for my next court date. I have not recieved the money retro to me from the first court date I just had, they said it would take 2-3 weeks. But I have not recieved anything as of yet. I'm confused, I don't know what happens now.

Generally, before your co sponsored ins plan is cancelled you can elect to continue it under COBRA, but you must then pay the premiums. And yes, you can be cut off and even fired while injured, and FMLA runs concurrent while you are out on comp. Nice, huh?

Being injured and out of work on comp is never good, and it is stressful as there is always a high degree of uncertainty regarding the future. But you should at minimum have more answers and be kept up to date on your claim's status. Lawyers are pretty busy, and worker's comp cases aren't very profitable, so don't expect to talk except when something is happening. That said, a little hand holding is to be expected and I think you may need a better attorney, or at least one who will keep you informed. Not much else I can say.
