Default What Happens To My Case Now?
After injuring L3,4,5 at work last March, jumping through the work-comp hoop, having 4 cortisone injections, doing PT. Saw 4 different work-comp surgeons. 3 said I needed spinal fusion surgery, the 4th said no. (Of course thats the answer work-comp insurance people went with) Even the physician that did the cortisone injections stated "I really don't think this is going to work, you really need surgery, but we've got to try".

At any rate, after not hearing a word from ANY work-comp people since July 07, (so now it's at seven month with no communication from anyone). I had to take things into my own hands, I went into my own doctors, they took new MRI's, x-ray, CT scans and I am scheduled for a 3 level spinal fusion this Friday. I told them it was a work related injury, and they thought it was rediulas and typical of work-comp to let people suffer, we have got to get you fixed immediately so you can get your life back. They also said that "conservative treatment" is 3-5 months, NOT ALMOST A YEAR. I am so excited!!! All I'm paying is my deductables.

Now, what happens. I couldn't wait for those work-comp people any more!!! With no word from anybody, I had to get fixed. I live in the state of Colorado.

Next step is to contact an attorney immediately. There is a statute of limitations for filing claims and you need to be sure it is handled correctly. He will get a big chunk but it will be worth it.

Thank you. Someone finally understood what I was talking about! As soon as I am recovered enough (surgery this Friday) I am going to be working my tail off looking for the Best help. Common sense says what happened to me is just not right!!!

Wish me luck on my surgery. I really am looking forward to it, and will absolutely do everything the surgeon tells me to do so that I recover wonderfully!!! Looking so forward to getting my life back, it's been a long long year...

Do you know any exceptional w/c attorneys in Denver?

In some states you could be held liable for the cost of a surgery done while circumventing the comp system by your personal insurance company since almost every personal insurance policy has specific provisions denying liability for workers' comp injuries. In some states circumventing the WC system relieves the WC carrier of liability.

That would leave YOU as the liable party for the cost of your tri-level fusion.

I'm not saying this will happen, I'm just saying it could.

i told my insurance company the whole story, and they said all I have to pay is my co-pays. Thank God!!! They actually told me that I could have taken care of this a long time ago, just as soon as I received that letter from work-comp stating "surgery denied". That really pisses me off due to I could have had this surgery done in July and already back to my normal life by now!!! Wish me luck for Friday...

The company insurer should be paying for all of this without you having to pay deductables. You need get a good WC attorney pronto! Before you submit to any surgery.You may be cutting yourself off from your rightful WC claims?
