Default Paternity Questions For a Father in New Mexico
A little over nine months ago a woman i was dating got pregnant. I believe the children to be mine, she had twins. But we never loved each other and to make a long story short, she basically disapeared. I thought she moved out of state. Then two months after the babies were to be born she contacted me. She had two babies, a boy and a girl. According to her, she could not take care of both, because she already has a 5 year old boy who's health is not that great. So she gave the boy to a couple, friends she said. Now almost a week before she contacted me, I was curious about the children and googled her, the mother. What I found was a petition for adoption for the boy. I told her, after she contacted me, about this and she said she had no idea and this couple was not supposed to do it yet. Since I found this out two months later, the legal notice said I loose all parental rights after 30 days...

She told me the story of this couple, how they have never been able to concieve and that the baby boy can be visited by us when we want down the road. But I never had any say in all this.

I guess I can add more details later... but what do you all think of this?


She has my girl, and I can see her when I want, she does live within 20 minutes of me... but what should I do, to prove they are mine... no legal paperwork exsist proving these kids are mine... though I assume it's safe to ASSUME they are mine... I am lost and need guidance.

I am no bad man... finacially unstable is my major problem. One reason the mother hates me i think... what should I do?

Do you know if your name is on the birth certificate? You need to file with the court to ask that a paternity test is done. You will not be able to visit the girl when ever you want (mom could change her mind) unless you have a court order for visitation/custody and you can not get that until paternity is established. When/if paternity is established you will also be required to pay child support.

... forgot to add I don;t have any info about what you can do about the boy but I'm sure someone else here can give that advice...

You need to hire a lawyer in the state where the adoption occurred, ASAP, and attempt to assert your legal rights.
