I have been tring to purchase a house for the last six months. I have been through 2 AOSs and at least 2 addendums rescheduling closing. The issue that delayed closing was that we did not have a short sale letter from the bank that was holding the current mortgage on the property. My title company also requested multiple pieces of other documentation. For the first four months I was given information to lead me to believe that the bank was responsible for the holdup. I finally contacted the loss mitigation officer at the bank and found that the lawyer representing the seller was not returning calls from the bank requesting more information. I was able to provide the bank with the information they required and after five months we recieved the short sale letter. During this time the lawyer for the seller had repeatedly promised my title company, the realtors, and myself to produce the documentation needed to close. After six months now, only half of that documentation has been recieved. I have sent countless emails and voicemails to the lawyer asking for updates on the status of the documentation. I think I've recieved two or three communications from the lawyer in this time frame.
My question is how do I motivate this lawyer to fullfill his promises of producing the documentation in a timely manner?
