    Default A Car Crashed Into My Parked Car

    Well, this happened in about June of last year. So here's the entire situation. I was at my gf's house and her neighbor's worker was driving their company Econoline van. He was entirely at fault and he smashed into my car which did a domino effect and hit my gf's car and her car hit the other neighbor's car.

    Both my gf's and my car was totaled from the wreck. Here's the dilemma though, their coverage on their insurance was only $5000 ! And $5000 for 3 cars isn't even close to covering anything. My gf has full coverage so she went through her insurance to get money but I only have liability insurance so I need to pursue them through small claims for more money.

    I've been asking the driver but he started dodging me so then I started to go to my gf's neighbor and he says he'll get the guy to pay or he'll try to pay some but none of these negotiations have been working. Its been 6 months already.

    HERE'S MY MAIN QUESTION. How do I get my money faster? Do I take both the driver and the neighbor to small claims OR take the company to small claims because it was a company vehicle?? I just want some help in getting my money ASAP. PLEASE HELP.

    why would you sue the neighbor? what did he do?

    Sue the driver and include the owner of the vehicle.

    Well what I was thinking was because he's the owner of the car AND the owner of the company that the driver was working for. AND the driver has been dodging me and his boss so I'm pretty sure he's going to be broke.

    I kind of missed that.

    Yes, sue the driver but include the company as well as the owner of the company. Better to sue all that may be defendants than miss one and lose out on everything.

    Are you saying their insurance, liability limit was a maximum of $5000?

    I have never heard of such a thing.

    Thanks, I'll be sure to write ALL of their names on the small claims forms.

    AND yes, their collision coverage or something was a MAXIMUM of $5000. It was a small subcontracting insurance company I'm assuming. Word of advice to everyone, get full coverage insurance. haha
