Default Texas Birth Certificate Laws
Can anyone please tell me the Texas laws on being married and the father not being present at the birth? Will he still be legally the bio father if he does not sign the BC?
There is a divorce in process that will be filed after baby's birth. Thanks for any help.

Under Texas law, your husband is the presumed father of your child. (Texas Family Code § 160.204(A)(1) - "A man is presumed to be the father of a child if ... he is married to the mother of the child and the child is born during the marriage".)

If the issue is that he is not the father, there are steps that you and he may take to disestablish his paternity and identify the biological father.
