    Default Driveway Land Line

    I own a multi famley house been in the famley for 20 years we have always parked one car on the side in between the apt hous next to my house .new owners sent me a asseres map the line on the map shows the property line is close too my house giving them the parking space .i found one property marker two house down messured the frontage from that marker down too my place comes up showing its my parking space ,can only find one marker on the street .any way thay say that they will have me towed if they park there and i will have too prove otherwise that the4 space is mine ,i dont want too have to pay too get a survie done .can they do this town assers said that the map can not be used too show bounderies .any help would be great im thinking they will have too prove too me by paying for a survay

    Generally speaking, assessor's maps are not meant to define property boundaries - they are prepared for the purposes of assessing taxes.

    Have you pulled the title report for the property? This is usually helpful in establishing boundaries, as is the property's deed.

    You might also check with your county surveyor to see if a survey is already on record. If it isn't, I would suggest offering to pay for half of the cost of a survey to settle the matter. Elsewise, I fear your only other recourse would be to take it to a judge.

    As you have discovered, there is no substitute for a survey.

    Assessor (auditor) GIS maps are notoriously inaccurate and have caused more mischief than you would believe. My county has a national award winning GIS system which shows my house lot lines off about three feet from the correct location. That is considered "good".

    I would suggest that you contact the assessor's office and put them on notice that you will consider them liable for any harm or damage to you as your neighbor intends to claim your land based on their map.

    They will already have disclaimed any liability or responsibility somewhere, probably in fine print on their website, but they may contact your neighbor in clearer language. It's worth a try and will cost nothing. It may do some good.
