    Default Help With North Carolina Child Support

    My fiance and I live in North Carolina, we have a baby that is due the 7 of february. He just recently lost his job in december, and now waiting to start at this other place soon. Since I can't work anymore we didn't have any income coming in and had to live with my mother. Now for the first time he has missed January child support. We've tried talking to his Caseworker and the caseworker won't take anything less then 350, which is what he pays a month. Now today he calls me to let me know that if my fiance don't pay by the end of today then he is going to get the sheriff out on him. Which means my fiance will go to jail, lose his new job, and most of all not be here to support me and his son since I won't be able to go back to work until my 6 weeks post-partum, and if he does goes to jail child support will continue to build and he won't have no job and will have to go right back to jail. What can we do in this regard? And how can we try to work out some kind of payment arrangement, I mean I know its possible because I had a friend that did that?

    I'm confused as to who "he" is. When you say "he" says he will get the sherriff.
    You are female, your fiance is male, and I guess he has a child with a previous woman. yet there is a "he" calling your fiance? If the "he" is his babys mothers boyfriend/husband, "he" has no say in what's going on with child support. Unless the "he" has legally adopted your fiances child.

    Anyway, I seriously doubt anyone will send your fiance to jail over a $350 late CS payment.
    There's steps that need to be taken, via the courts, for anything to happen to your fiance.
    You can't call a sheriff to go get someone, unless there's something in writing from the courts, saying that there's a warrant for his arrest. Unless you live in Maybury RFD, sheriffs just don't take peoples word for things.
    Also, the case worker wont take less than $350?
    Case worker for who? And is the $350 a fee of some sort?
    keep in mind, your fiance does have an obligation here. If he loses his job, and is waiting for another, then he really look for something in the meantime. Mcdonalds, walmart, anything. At least this way he can show the court he's at least trying.
