I would like to know what happens to a person's tax refund when married and filling jointly however, only one person is on the chp13?
The non-bankrupt spouse can make a claim with the trustee for his or her pro rata share. A more detailed answer can be found here.
what determines the spouses half of the refund? My spouse definately made more than me and paid more than me, so shouldn't he get more back.
This all confuses me since my refund portion will be used to pay the attorney's fees and some essential expenses. How does the trustee take your refund? Do you have to just write them a check or do they freeze your accounts?
