Default How do you force a paternity test to disprove fatherhood?
Hello, I have a question for you guys. My fiance is divorced from his Ex-wife now for 3 years. There were times where they have been intimate after the divorce. (very recent after the divorce) I have a 15 month old son, she has a 12 month old son. She makes claims to everyone that her newest baby is my finace's child. These claims are driving me crazy, as we live in a small town and her 6 year old (who IS his son from their marriage) goes to the same school as my 6 year old daughter. It's very embarassing to me. He is getting tired of swearing to me it's not his child. The thing is, she's claiming it to teachers, friends, family and anyone who will listen, HOWEVER, here's the sticky part, she's NOT claiming it to family court, or child advocate or health and human services. She already gets child support from him for the 6 year old, yet she hasn't asked for a dime for this child? It doesn't make any sense! Is there anything we can do about this? Can we force her to do a paternity test even if she's not asking for money? Can we force her to give him a copy of the birth certificate? Please give me any advice that might help! She's only doing this to make me nuts!

Default Paternity Action
It's a bit tricky... the father can initiate his own paternity action and demand DNA tests, but there's a chance that the mother would default. I suggest that your fiance discuss his situation with a local family lawyer to see if he can safely pursue a paternity action and get DNA tests with the goal of disproving paternity.

he can buy a paternity test online. They are pretty inexpensive. He can get it done privatly. A home paternity test. Look it up. Now he would have to come in contact with the child to get the cheek swab. But this will put an end to any questions. They are accurate! Now you have to make sure you get the one that is right for you. They have the ones that are just to put ease to your mind. Others hold up in court, and some don't even need the mother's DNA swab. I would check into this online, for your own relationship, if nothing else..
