    Default Tricked Into Signing A Quit Claim Deed

    The State Is Oregon, My Girlfriend I Feel Got Conned A Guy Claimed To Be A Home Broker And Had Her Ex Husband And Her Sign A Quit Claim Deed Telling Them That He Needed That To Help Them Sell The House And It Would Give Him Rights To Talk To The Morgage Company. He Had Them Move Out In A Rush So He Said He Could Start Showing The House To Buyers Then He Moved In And Started Running A Buisness Out Of It No House Payments Are Being Made For The Last 5 Months The Deed Says,
    Know All By These Presents That "girlfriends Name And Ex Name Property Located At The 1234 Se Conned Rd Oregon 97123 Hereinafter Called Granter, For The Heir Consideration Hereinafter Stated, Does Hereby Remise, Release, And Forever Quitclaim Unto Conn Mans Name And Adress Hereinafter Called Grantee, And Unto Grantee's Heirs, Successors And Assigns, All Of The Grantor's Right, Title And Interest In That Certain Real Property, With The Lenements, Hereditaments And Appurtenances Thereunto Belonging Or In Any Way Appertaining, Situated In The County's Name County, State Or Oregon, Described As Follows, To Wit:
    Property Of Lot Name In The City And State Subject To Covenants, Conditions, Restrictions, Reservations, Set Back Lines, Powers Of Special Districts And Easments Of Records, If Any Tax Map Or Parcel Id No.

    Also It Says To Have And To Hold The Same Unto Grantee And Grantee's Heirs, Successors And Assigns Forever. The True And Actual Consideration Paid For This Transfer, Stated In Terms Of Dollars, Is $1.00 And Other.

    So In Which They Never Recieved A Dollar From Anybody So Would This Mean That The Deed Is Not Good? Well Is There Anything We Can Do Like Move Back Into The House And Tell Him To Leave And Does The Deed Mean They Have No Rights To The House At All Like To Sell It???? Please Help

    Your girlfriend needs to hire a real estate lawyer to try to have the deed set aside.

    Ok But Intell Then Can She Move Into The House And Make Him Leave? And Is There Anything Else We Can Do Right Now Before The Lawer Comes Into Play

    Check with the county recorder and see if the deed she signed has actually been filed. It only takes a phone call. Ask the recorders office what the policy/procedure for petitioning transfers. They will probably tell you to get an attorney but at least then you will know. Ask them to send you a copy of what was filed.
    Her signature as well as her ex's must have been notarized to do this.
    Don't do anything about the house until what your looking at. Find out if the deed was actually transfered, then you can figure out the options.

    The deed itself may in fact be legally sound. The worst thing to do is to try to take the house over again. Self-help in legal situations never leads to good results. However, while the deed may be good as a deed, it is a contract, and the contract is probably not legally sound. If everything happened the way you said it did, fraud was at play and the contract would be void if you can prove this in court. Get a lawyer. Also, if the $1 has not been paid, then the "Con Man" is in breach of the contract... But even if that's the case, that would allow you to sue and get $1. You need a lawyer.
