I am in Tennessee and went to court today for an appearance. My probation extension is coming to an end in Feb and my restitution has a remaining balance of 40,000.00. I was originally sentenced to 4 years probation and I have been extended 3 times because my restitution has not been paid in full. The original agreement was that I would pay $200/month. I have paid this amount every month and have not been in any trouble.
Today the prosecutor in the case said that he probably needed to draw up a revocation warrant since the amount was not paid. My attorney argued that the court no longer had jurisdiction over the case and that revocation warrant was ridiculous in this case. I have made the payments like I am supposed to and they knew that I would not have this amount paid off in the 4 year period. So why did they agree to the amount?
My question is.....does my attorney have an argument?
