    Default Harrassed Just Walking Down The Street

    So the fish bite when im not trying to catch them? Anyway

    I was walking down the street around 1am when I saw a cop car fly by me I thought nothing of it and kept walking 2 minutes later I saw a car coming up behind me I knew it was him as I saw very little cars on this road. Sure enough the cop stopped by me and when he got out, I hit my PDAs panic feature while it was on my belt clip. Here is a brief exchange that took place. (NOTE I DO NOT LIVE IN A STOP AND IDENTIFY STATE)

    Cop: "Where are you going at this hour?"
    Me: "As if I have to answer that, you aren't my keeper, F**k off"
    Cop: "I'm going to warn you once about the language and do you have any ID on you?"
    Me "I'm going to warn you, that you are an idiot and that contempt of a cop isn't illegal and I'm not driving so I don't bring ID"
    Cop:"Last warning and so you have no ID on you at all?"
    Me: "Thats right"

    He asked for my name and address which I gave him my address but gave him my old last name that has been changed. The reason for this is he would have seen the gun permits and then "found a reason" to search me. He went back to the car to run my info and I just laughed and said that was some fine police work there. He came back and said everything had checked out and that im lucky he was cutting me a break. I asked what he meant and he told me he could have made up charges on me. I asked him "you mean drug charges and such?", his reply was yes. I then laughed at him and said thanks I I just hit the jackpot. It was only now that he noticed my PDA screen glowing with an active call. He tried to take a look at the number and I blocked it. I told him that don't even try the warrant thing that its extremely protected and that the audio/video recordings sent to this computer get uploaded to an international server that cannot be touched by US law.

    I'm not looking to get the cop into trouble with his dept..I'm looking to sue. Would I be able to sue for wrongful stop and threats to make up charges against me and DMCA violations?

    I know but I think it has to do with my pending lawsuit I have against one PD. I wont give all the details but a cop was bothering me one night while with a friend I asked my friend to drop me off at my houseboat instead of my real house..cop followed..tried to board my houseboat while I was leaving port and I came out of the cabin and he was on deck so I gut punched and shoved him off my boat and left my slip. No charges were filed against me but I filed against him and his dept for home invasion, attempted hijacking, harassment, warrantless entry, and a few others.

    Wrongful stop? Where. He did not restrain you and apparently you did not ask if you were being detained so what stopped you from walking away?

    A cop is allowed to walk up to you and ask you anything he wants.

    Threaten to make up charges? Did he? Apparently no so you have no claim against him.

    You could file a complaint with his department but you want to sue. You don't have grounds to sue but you do have grounds to make a complaint.

    Umm, I said a brief there was far more to that encounter than I listed. I like pissing cops off cause I do it within the law as in not illegal. I'm extremely passive-aggressive and I show it to cops the most. But that wasn't the case, the case is I was stopped for no reason and wasn't free to go. thus wrongful stop. I don't care how bored a cop is on a slow night harassing me is looking for a lawsuit.

    Umm, so why do you claim you were not free to go? An officer can stop you anytime they want (not illegal). It is when he actually detains you that things get sticky. How did he detain you?

    So what. Cops threaten to arrest people all the time. There is nothing inherently illegal about it. Your emotional distress is BS and will get you nowhere. Have you lost hours upon hours of sleep because of it? Have you been to the doc for treatment?

    Didn;t think so.

    No valid claim.

    Well, you might rather want to sue but you still have absolutely no claim to sue for. A complaint is the only thing you have available to you as far as actions against the officer.

    then call up an attorney and let him tell you what charges can be filed, as long as you can prove it.

    I think this guy is a an a-hole...
    ...but I need to remind folks that we do have a 4th Ammendment. Granted, in the name of Terry Stops and DUIs, that right gets thrown right out the window. *gotta love MADD and the DUI Exception to the Constitution*. If it were me I would have said I thought you were drinking and pulled you over in the name of all things DUI and Public Intox or that we pulled you over as part of a roving DUI patrol (much more effective than checkpoints). ...and told you to watch your mouth.

    In the state where I lived (WV and GA) he is (you are) within his legal rights unless there is probable cause or it's a random DUI stop. It would be an easy arrest (without ability for false arrest charges) for an "Obstruction of Justice" charge in GA. I got arrested for telling an officer I did not have to tell him where I worked. He made up charges (distorderly) that a judge later dismissed. Granted, I had to promise the judge I would not sue the officer as I had already filed a complaint. His department found that he did falsely arrest me, but EXONERATED him (and it was in all caps). If he would have hit me with disorderly I could have kissed the guilty conviction hello in 2 months.

    Striking an uniformed officer and pushing them off a boat. If I were that officer I would have pulled my service weapon and shot you, even if you had a Yacht license and it was a federally registered ship and not a state registered ship.


    ...and you are probably missing a career with the Police Complaint Center (it's a D.C. non-profit).
