Holding Prior Owner Responsible for a Defective Roof

I bought a prefab house a couple fo years ago. The company was sold shortly after. The new owner signed an agreement with former owner relieving new owner of all liability for houses sold prior to the change of ownership. The new owner has since evaluated the roofing system and made significant changes based on design flaws he found. He has also instructed prior owners on making retrofits (at their expense).

What is my recourse if any in getting the former owner to assume liability for roofing retrofits?

OK, so if the house came with a 1 year warranty on materials would that also include design flaws which cause roof to leak? Can they really just use a warranty time limit to get out from bad design liability?
