Default my boyfriend got charged with spousal battery
One night me and my boyfriend which is 25yrs old, got into an argument we were arguing really bad, that night he went into the restroom and I followed him we argued more well to make the story short I pushed him and he pushed me then I went to the living room got my baby and sat on the couch I got the phone and dialed my mothers house number, while I was on the phone with my stepdad he kicked me 3 times, I called 911 and told the operator he was getting violent when he heard me tell her that he ran out of the house, she asked if he was still there I said no he ran out, she said call back if he comes back.

After that he didnt come back I went to the local police department and filed a criminal report. I said exactlywhat I wrote here. The deputy told me that since I didnt come in with any major injuries that, it was considered spousal battery and that it was a misdemeanor. For that reason they could not go and arrest him right there and then.

Well we are still together but now he has to present himself in court. and he is scared because he is going to jail.Now he wants a public defender.my question is , does he need one? he has never been convicted of any type of crime, or been in jail for anything so he has a clean record.
what are the chances he has to go to jail?
I need some advice he is driving me nuts.

He would likely benefit from consulting a lawyer.

He COULD go to jail ... most likely he will get probation, a fine, and 12 months of Anger Management if convicted.
