Question Billed For Medications After A Workers' Comp Accident
Louisiana
I was injured in Feb. '05 and my original WC doctor is a orthopedic surgeon. After 7 months with no surgery approved yet, I was having severe depression and headaches. I was seeing my family doctor for these problems. Starting in Oct. '05 WC started paying for the meds related to this. There was an account set up at the pharmacy for my meds, up until that point I paid a co-pay and my insurance was paying...I did not have an attorney so I just paid them but, in Oct. '05 I went to get my RX's and they said no charge...WC paid for them (only ones related to my injury). They continued to pay until Feb. '07 and I received a letter billing me back for these meds from Oct. '06-Feb. '07 saying not WC doctor. They had paid them for over a year, I had informed WC that I had to see another doctor for this because my orthopedic doctor didn't treat these problems. My attorney filed an appeal and I am going to a meeting with The Dept. of Labor next week, WC and my former employer are to be there. Can you tell me if you feel they will rule in my favor? The bills from those dates have been turned over for collection and are now on my credit report for non payment. Please help...

You have an attorney and are going for a hearing. Your attorney is in the best position to answer your question.

Thanks Ipat....I have asked my attorney...anyone tried finding a WC attorney in Louisiana? it's about impossible. Everything that has went on during this time, I have had to do most of it myself. He told me several months ago, if he doesn't make anything from it he is not going to waste his time. That's were I'm at. My long term disability policy stopped paying in July...he did nothing, I appealed it and it started back in Dec. after being seen by their psychiatrist. I just thought someone could give me an idea if they should pay for these meds...
