Default Metalworker With Breathing Problems In Louisiana
I developed a lung condition from the environment inside the shop at my work. They have offered to move me to another area but, want me to sign paperwork saying my illness is not work related. Since I only get sick at work I don't want to sign. I have not filed for W/C. I would like to try the job in the other area but, I am afraid if I take the job they will let me go shortly and I won't be able to file for W/C at that point. What should I do? Also, if I'm still under my doctor's care can they fire me?

You might want to check in with the folks here.

Most of the contributors there are injured workers dealing with the system and can speak to your issue from experience.

It sounds like you also need to speak to an attorney about your rights. Louisiana is an "at-will" state - being under a physician's care will not prevent them from letting you go.

File a WC claim immediately--that is the first step. They cannot fire you for filing, and if they do, it is illegal and you can hand their behinds to them on a platter.

WC will determine if the illness is work related or not. If it's work related, they will cover any treatment you need. If it's not work related, then you go back to square one.

DO NOT SIGN ANYTHING SAYING IT IS NOT WORK RELATED.

File now--it is illegal for them to retaliate.
