    Smile Is It Child Support Fraud To Not Give Support Checks To The Child

    I am the child that is suppossed to be recieving child support from my father- but i never have. the child support payment is 360 a week. I am 18 years old now, & have moved out of her house. My father says he has to pay chid support until I'm 21, but my mom is still getting & keeping my child support checks. My father said that the law prohibits him for sending it to me directly, i know for a fact that ,my mother has been using it to support her self. she does not work, lives in a very nice house on long island NY & she supports my brother (who does not recieve child support for my father because he isn't my brothers father.) I asked my mom if she could foward the checks to me...she refused started yelling & arguing with me- & when i asked her what she's spending the money on she said in her exact words "We can discuss this some other time" & hung up the phone. should i press charges? im not interested so much in getting the money ( although that would be really nice) i just want her to stop using me for my money like she has for her whole life...I really need help with this, if you need more information please don't be afraid to ask me.     Well, 1st of all, it isn't your money. I know you'd like to think it is, but it's not.
    2ndly, Are you in college?? IF not, and you moved out, and are supporting yourself, you may have emancipated yourself. In that case, dad has to go back to court, and tell the judge that you are emancipated. It would help if you there for that hearing.
    If you are in college, and dad is paying tuition, he can go back to court, and ask that child support payments be at least lowered.
    If you're 18, and still in high school, then, he still has to pay mom.
    But again, it's her money, not yours. Sorry

    i am not in college , i was in college but i moved away so i had to drop out.im to poor to go to college now. I graduated high school.

    okay i understand one last question. If i need the money for my own support (ie paying rent or food) can she still refuse to give me the money?

    If you are living on your own and responsible for paying your own bills than your are emancipated. Tell your father so that he can file to stop child support due to emancipation of the child (you).

    You can NEVER legally collect child support from your parents...If you are living with a guardian WITH YOUR PARENTS consent, THEY can file for support from both your parents. But that is for them to use toward that cost of providing you a home, food, clothing and medical...

    The child support your mother received while you lived at home helped her to pay for the roof over your head and the food in your belly - not to mention clothes, medical care, transportation, etc. etc. At $360 at week that is about $9 per hour. Try supporting yourself on $9 per hour and I'm sure you will see that your mom provided you with quite a bit more than $9 will get you - and she was probably not using you for the money.

    Your dad should file to have child support stopped now that you are on your own.

    I do feel sorry for you that your mom doesn't share some of the money with you. It sounds a little selfish to me & greedy on her part. You must of had a fall out with her & she is holding a grudge? Anyway if your dad cuts her off she''ll be the one most affected, as she is used to having a certain amount every month. What you are experiencing is tough love which will just make you have to work harder for what you get. In the long run you will be better off not be dependent anymore.
