    Question File Married Or Separately In Florida

    My husband and I have been living seperately since September 2007, but the divorce has not ensued as of yet. Tax season is near and he is pushing me to file Married filing Seperately instead of jointly. I don't know if there are legal guidlines to this and if there is not, which would be more benificial? He makes about thirty five grand a year and I only brought in working part-time seventeen thousand. He told me that he would give me "some" money from his return if we filed seperately. But he is hurt and I can't take his word. What should I do?

    If you are having a civil divorce. Then I suggest you go to a tax office. See how much you would get back if you file seperately or jointly. If you get more filing seperately then file seperately. If you get back more filing jointly then file jointly. Just make sure you have a solid aggreement on how much the split will be.

    There are no laws that state you have to file jointly if you are married. You have the option to file seperately if you are married.
