Default Getting Vacation Pay While On Worker's Compensation In Indiana
I have had 2 back surgerys since July 2007. I fell on black ice in parking lot at work in Indiana in Feb.2007. Have been off work since MAY 2007.
workmans comp said I was entitled to my vacation pay for 2 wks in July, but boss said I had to be at work to get money. Can she do that? I know have hardware in my back, and still in alot of pain.Do I need to get a lawyer and will I automatically get a settlement

To the best of my knowledge, you can only collect vacation pay that you have already accrued prior to your WC claim. Had you already accrued this vacation pay? O would this have accrued after your injury?

A lawyer is certainly in your best interests. There is no way to know if you will automatically get a settlement.

If you mean, does every injured worker get a settlement, then the answer is "no".
