Default Use of Elderly Grandmother's Credit Card In Missouri
A few months ago, my husbands grandmother we were living with. She wanted to help us get caught up on our bills and agreed to opening a new credit card due to a low interest rate. Well we put her information in online application and she was approved. I was added as an authorized user. A few weeks later the cards came in and one check. So, I wrote the check out on her behalf and deposited it into my checking out. A week later after the deposit was made, she received a call and they asked about the check. Just recently she has been forgetting, but we were not aware of this at the time. She told them she did not remember and didn't think she authorized the check. The rep advised she would put a stop payment on the check and asked if she wanted to report unauthorize use by me her granddaughter. She said no, they said they would not file charges. She put the money back into our checking account to cover the return check, b/c she realized that she did authorize it, but when she tried to call back they had already stopped the check and she did not want to bounce our checking account. Could they still come after me, even if she says no. I haven't heard anything from them and the deposited check came back unpaid. But, recently I received a letter from the division of senior & disability services, in which I go tomorrow to find out what it is about. They said it was about his grandmother, but they are investigating a report, which has a current situation, and is necessary to determine the facts. Should I be worried, have I done anything wrong and if I have what could be the penalities. I have never done anything wrong or been in a situation like this. What am I looking at here. Just nervous.

It appears that there is concern that your husband's grandmother is not legally competent, and that you and your husband are financially exploiting her. It's all "up in the air" right now - we don't know what the investigation will uncover, or what the Missouri Department of Health and Senior Services will recommend.

Well, she suggested this at the time, we have never took advantage of her. I think though now, she is having problems remembering everything. I am not sure. But, she told them not to press charges, it was her fault she stopped the check.

I am not sure what you are saying.
