Hello,

I received a summons that was left in my mailbox late one evening. I hadn't been home when they came so they just left it there. It wasn't even in an envelope.

My question is this: The date filed said December 5th, 2007. The date I received it in my mailbox was January 11th, 2008. It explains that I only have 30 days to 'respond' to this summons.

So, I have no idea how to 'respond' other than call the attorney's office listed on the complaint that is the attorney for the CC company and ask them. I will do so first thing Monday morning but, am I all ready too late? Is it 30 days from the date the paperwork is filed or from the date it was left in my mailbox? As wasn't home when they came they don't even have my signature or date or time that it would have been 'properly' served, if such a thing is necessary.

The deadline is thirty days from the date of service.

You should check with the clerk of court to see when they are claiming you were served.
