    Default ETO, Sick and Vacation Time After Quitting A Job

    My employer gives out vacation time based upon the number of hours worked. For example, every 32 hours worked gives your 1 hour of vacation time. Also, the hours are earned starting after 30 days, but can't be used until after 1 year. So, I've been accruing my vacation hours for almost 9 months now. The way the company states it is that I have earned 25 vacation hours for next year. If I decide to quit before I hit one year, do I lose those vacation hours? Or am I entitled to them? Also, my employer has ETO (earned time off) in addition to sick and vacation time. So for example, right now I have 18 ETO hours, 25 vacation hours, and some sick time. I understand that in MA I'm not entitled to the sick time. Are there any laws in MA about ETO? Is ETO entitled like vacation time or is it similar to sick time?

    You'll have to define what ETO covers before I can tell you. Under what circumstances do you use it?

    Warning: MA has perhaps the most complicated laws in the US when it comes to the payout of unused leave.

    I'm not sure of the full definition, but ETO is used when you need one or two days off for such things as appointments, car repairs, family party/birthday, etc. Although I'm not fully sure, it seems to me that ETO is used for one day here and there, while vacation time is used for extended periods away from the job. I will try to ask at work what the full definition of ETO is and then get back to you. Thanks for your help!

    Yes, I earn 1 ETO hour for every 32 hours I work and I earn 1 vacation hour for every 35 hours I work. And as far as I know, both can be used at anytime.

    If the ETO can be used at any time and for any reason, then my opinion is that the state of Massachusetts would consider it the same as vacation and it would have to be paid out.

    However, if it can only be used for certain, limited reasons, then again in my opinion it would be considered the same as sick time and it would not have to be paid out.
