Default Billed For Charges On A Credit Card I Didn't Receive
Hi Guys,

This is my first post.

I applied for Capital One credit card but didnt get the card on my mails,after 3 follow up phone calls,they said someone activated the card and used it couple of times.I signed a Fraud Information Form and filed a police report.After a week, I received a letter from Capital One stating that company's fraud department has completed their investigation claiming this account was activated from my home phone and they've found no indications of fraud. Now they said i have to pay $340. Do I really have to pay that? Is there something else I can do?

Please can someone be kind enough to tell me what to do next. Any suggestion reply will be really appreciated.

This is pretty simple to solve. Either your home phone records will show a call placed to them on the day in question, or it won't. If your home phone records are clear, then you may have a good identity thief at work, complete with phone spoofing. If that's the case, get on your credit report ASAP and see what other possible accounts night have been opened, etc.

If the call DID come from your home phone, you've got a bigger problem than $340 You have someone with access to your telephone who is willing to screw you over. Got roommates? Teenagers? Cleaning people? Vindictive ex?

Phone records won't necessarily show a call to a toll-free number, and I've never seen an activation number that wasn't toll-free.

You can also investigate the purchases - where they were made, and what was purchased.

You should make a police report.

(Note that I'm assuming your story is accurate. Don't make any false or misleading statements to the police.)
