    Default Moving Out Of State To Be With A Boyfriend

    Ok this is how it breaks down i am doing this for my best friend she needs out of her home bad. she is 16 and her bf of almost 2 yrs now moved to north corilnshe was fine with that now she engaged to him to be married when ever they can her bf is 18 by the way. He works full time she wants to move down there with him but her mom will not let her because idk but yeah she found out by a couple of the teacher at ur school tht she has to be emancipated to do so so would it be legal talking about new york. help if u can

    Emancipation laws are different in each state. Are you stating that she lives in New York?

    Although there is no statute, New York apparently recognizes a common law path to emancipation. The following are elements that are generally described as what a minor must establish to achieve emancipation in New York.
    • The minor must be aged 16 or older;
    • The minor must reside independently of his or her parents;
    • The minor must be self supporting (although public assistance or court-ordered child support payments made to the minor would not disqualify the minor from being recognized as emancipated);
    • The minor must not be in need of or receipt of foster care; and
    • The minor must be living beyond the custody and control of his or her parents.

    No state considers "I want to move in with my boyfriend" as a valid basis for emancipation.

    yes she lives in ny. so what u are telling me is tht she can emancipate herself as long as she can prove tht she will be finacaly set?

    Not at all. Did you read the following?

    No state considers "I want to move in with my boyfriend" as a valid basis for emancipation.

    She cannot be emancipated unless she is capable of self support. However, just because she is capable of self support does not mean she is guaranteed emancipation.
