    Default My Lawyer Sold Me Out

    My lawyer in a custody case wrote a letter that me and my wife were both unaware of. The letter stated in nonspecific terms that we had an agreement. We infact disagreed with the proposal and our lawyer told us that we had the option to throw it out. We did this and contempt charges were filed. We then found out that this action would require our lawyer to have to quit because he would have to testify. We have since gotten a new lawyer. We have gotten a new lawyer but he says that there is a possibility that the agreement will be enforced. Can you be held in contempt on something that is not signed by a judge?

    It is going to depend upon the circumstances. If there is an agreement made on the record, or a ruling issued from the bench, the court can reasonably expect compliance prior to the entry of a written order.

    Also, laws and court procedures are different in each state.

    Talk to your lawyer about the specifics of your situation under the laws of your state.
