    Default Job Protections and Confidentiality with Medical Disability

    I live in California and my doctor wants to take me out for 8-12 weeks for a non-work related medical disability. A few questions, please:

    1. What type of disability do I file (family leave or STD)? I have over 300 hours of personal sick time accumulated.

    2. Is my job protected? I'm an exempt employee.

    3. I don't want the nature of my medical condition revealed. It's not permanent. I know it will be on the form from the doctor to HR, but I don't want anyone else to know.

    Any advice is extremely appreciated. Thank you.

    1.) Leave is the time you have off. Disability is how you get paid while you are on leave. You apply for both.

    2. The fact that you are exempt has nothing to do with job protection. If you qualify for FMLA your job is protected; if you don't qualify for FMLA it is not. NOTE: FMLA protection runs out at the end of 12 weeks.

    3.) So who said anyone else had to know?
