Hi i'm from Mass. and on christmas i was involved in an accident. i was traveling on a 4 lane highway that was splitting with two lanes going to the left and 2 continuing straight. i was in the lane 3rd lane from the left and the 1st lane going straight; going between 40 and 50 and a car came from my left at the begining of the spilt and within seconds slammed on their brakes. i slammed on my brakes but still skidded into them. their car had minor damage because it was a jeep and higher then mine but my car has pretty bad front end damage. the state police arrived and didnt issue a citation to either of us. i dont have collision and when i reported the accident to my insurance they advised me to put in a claim with the other persons insurance. they also said they weren't listing the claim as a rear ending becuase the other car came into my lane and slammed on their brakes. my question is can i reasonably expect to have the claim settled in my favor? i spoke to the other drivers insurance and they said they are trying to determine how long the other car was in front of me before hitting their brakes. i'm frustrated because i shouldnt be held at fault if the other car wasn't in the lane they wanted to be in and realized it as the lanes were spilting. they sped past me to cut me off and obviously didnt anticipate thatthey would need to slow down.
