    Default Negative Balance On Checking Account

    Hello,
    Around one month ago, thanks to one forgotten automatic payment, I manage to get into negative balance of $500, most of that is overdraft fees.
    I'm out of U.S. right now so I have no way to pay another two weeks at least, and I'm wondering what can happened to me legally?
    Can bank sue me?
    Take my car away (since that is all that I have that cost more than $500)?

    I'm foreign exchange student, so I'm not familiar with all this stuff. I will pay as soon as get back to USA, and in that time its going to be over two months since I got into negative balance.

    In what kind of trouble am I??

    If you wish you can send your bank a check, or wire them money, to cover the shortfall.

    Let me guess...the bank is Bank of America?

    Never the less, its your responsibility to keep your bank account funded and banks do not look highly when they have to fork over dough that is theirs.

    If you do not pay the entire balance, you will never be allowed to open up another bank account in America again, because your name will be flagged as you owing money to such and such bank. Until you clear your debt with that one bank, you cannot open up another bank account. All banks I know, have a toll free number that you can call. What I would do is talk to a customer service rep with the bank and tell them your situation and ask what you can do. You might find that they are more than happy to help you out...no kidding. They just don't help out those who try to avoid paying and ignore them. By you making an effort to right the wrong, I would say that they would knock off some of the overdraft fees. I have had many overdraft fees refunded to me, just because I asked.

    And if you get a really stingy rep, hang up and call again, to talk with a different rep, who seems pleasant over the phone. Be as friendly as possible and explain your situation with as little detail as possible, but say it in such a way to show that you are distressed over the fact that the amount is so high. Basically, just ask what your options are.

    Note to OP:
    HSBC is probably the worst bank...so whatever you do, don't jump from the frying pan an into the fire. I only say this because I have only one time in 2 years actually spoken to one person (several calls due to identity theft) who actually speak english that I can understand. One time I called a toll free # and they told me "You havta call US" I was in the US! I hope it works out for you.
