    Wink Determining Fault For An Accident

    Arizona

    My Daughter lives in a condo and was driving down the road behind another vehicle. They were driving southbound and the driver in front opened his garage door which was on the east side. He proceeded to turn towards his garage, there was ample room for my daughter to pass by him to proceed to her house. When she was more than 50% pass his truck he backed up into her. When I spoke to the guy that hit her he said " I saw her behind me but I thought she was going to stop."

    Both drivers are insured by the same major insurance company.

    My question is does anyone know of the laws as to who would be considered at fault in this situation?

    I can only guess, as I have only a partial version of how the accident occurred, but I would put most or all of the fault on him.
