    Question Trying To Get My Girlfriend Emancipated

    heres the deal. my girlfriend is 16 years old. she is currently living with her fosterparents, and they do not get along. im an 20 years old and going to college. we plan on getting an apartment and living together in the very near future. she has a job, and im getting a second job. we will have more than enough money to live on our own. im gonna continue at college, and she is gonna continue high school. is there anything i can do to convince the courts that she should get emancipated.

    The chances that a judge will emancipate a 16 year old so that she can live with her 20 year old boyfriend are exactly zero.

    Recall also that this would end up before the judge who is responsible for placing her in foster care. Under Indiana's statute, a "child in need of services" can emancipate, but the statute anticipates that the petition would be brought by protective services or a prosecutor. The minor must be able to support herself (sharing costs with a boyfriend is not the same thing) and must have "an acceptable plan for independent living" - and, as cbg says....

    Okay, I want you to sit down and think about this very long and hard. You are 20, she is 16. She wants out because she is in the rebellion stage of her life. Have you really looked into what everyday liveing costs? What if one of you got sick? What if one of you lost a job. What if she got pregnant? Talking from expiriance, you got to be a kid, and she would be growing up right now. Let her be a kid for a while longer, see where things are in two years for you two. It may not seem fair, but she might not be ready for such a huge change in her life. I don't recommend trying to convince the court of anything, because in all reality, the court is not really going to listen to you. You are not family. But if both of you still want to go though with this, more power to you. But thing very wisely.
