    Default Workman's comp

    I was injured the end of May. I filled out the paper work did everything I was suppose to. I was on light duty until August when the doctor told me that I could work but was to have no use of my right arm. When I took his slip to the staffing department and talked with my clinical director she told me that I wouldn't be able to work then. I have been off work since the beginning of August. I had surgery scheduled in August but workman comp. felt it was in their best interest for me to have a second opinion so I went and their doctor said I needed to have the surgery so finally the surgery was scheduled. The day before I was to have surgery I saw the clinical director and she wanted to know when I would be coming back to work I told her when I was going to have surgery she said that my FMLA would soon be ending in 2 weeks and that people were bugging her wanting my scheduled position can she give my position away? If it wasn't for workman's comp. I would have had the surgery and been back to work already.

    Default Injured at Work

    If your FMLA leave is ending but you remain disabled due to a work-related injury, your workers' compensation benefits should continue. If you believe that your employer is trying to terminate your employment instead of offering the benefits to which you are legally entitled, you should consult a workers' compensation lawyer in your state. Given the timeline you describe, doing this soon seems like a good idea.
