Texas Cosigner Takes Possion Of Vehicle And Make Payments

I cosigned a loan for a vehicle that has had late payments. I obtained possion of the vehicle and decided to keep it and make the payments. Can the co-buyer (cosigner) keep the vehicle make the payments without the buyer (the person I cosigned for) getting it back after I make the payments?

He has as much right to the vehicle as you do even when the loan is paid in full. Whomever is named on the title at time of purchase has rights to the vehicle once the loan is satisfied. Any other rights of possession must be determined by court order.

Since you co-signed for the loan, you are just as responsible for the payments as the other party no matter whose name(s) is/are on the title.

However, as indicated, the person(s) whose name(s) is/are on the title will be entitled to the car when the loan is paid off. If the other party gets the vehicle, you can sue them to try & get the car or to get back the payments you made.

How can I find out who is on the title of the vehicle?

The place where you got the loan can tell you or either the DMV. The loan co. may still have the title.

I called the loan company I was told they didn't care who has the car just that the payment is made. I have the only keys to the vehicle. Can it be towed away by the 1st buyer to get possion? I have tried to refinance but loan amount is less than payoff I would have to come up with $4,500 and can't at this time. I will call on Monday for title information they are closed today.

Look at the vehicle registration. That should give you an idea of how the car is titled.

I have verified that I am on the title along with the buyer. I have ask the buyer to sign off of the vehicle with no results. What do I do now? How can I keep possion of the vehicle and make the payments? Can the buyer have it towed or have a key made to take possion of the car?
